Purpose of the Position:

The position is required to handle product based litigation arising out of claims made by customers against alleged manufacturing defects and servicing of cars. The position also has responsibility of owning the data on product cases and handing customer complaints where escalations are made to Legal Department. Also supporting business in commercial property transactions and issues pertaining to labelling and packaging

Authority:

1. To represent Company before various judicial bodies / Local Authorities / Police & Investigation Authorities.

2. To execute documents on behalf of Company based on Authorisation Schedule.

Skills Required:

  • Solutions oriented approach to the business needs with strong inter personal & conceptual skills
  • High level of integrity and compliant behavior

Key Responsibilities &Tasks:

A) Litigation:

1. Independently handling litigations including conducting analysis, evaluation and defence of any legal dispute on behalf of the company at various courts, forums, tribunals, corporations, commissions and other judicial bodies that may be required from time to time.

2. Ensuring that Company is represented by capable lawyers for legal cases all over India.

3. Independently handling alternate dispute resolution including proceedings under arbitrations and mediations.

4. Briefing advocates on records of the company before different courts, forums, authorities, etc., as required all over India.

5. Independently drafting legal replies, para wise comments for products claims in co-ordination with various brands.

6. Independently developing the monthly reporting system and ensuring dissemination of the same to the brands for inputs on legal cases.

7. Handling legal cases for overseas Group Companies and ensuring that the matter is suitably represented before the various forums.

8. Endeavoring and assisting the brands wherever required in reaching settlements in the cases filed before various Forums or Courts involving dispute(s) and preparing necessary documentation for the same.

9. Handling criminal complaints filed by customers, dealers, vendors, etc before police authorities / criminal courts.

10. Active participation with the police authorities and other investigating officers during inquiry / investigations.

11. Handling employee (including third party) related issues/court cases for sales related functions. Provide assistance in mitigating such legal disputes.

12. Actively supporting all Group Companies including overseas companies in areas of litigations and projects involving these Group Companies in India.

13. MIS on litigations & legal notices.

14. Regular reviews with business teams on active litigations and notices.

B) Documentation and Advisory:

1. Independently drafting, vetting and negotiating of various contracts, settlement deeds and other legal documents.

2. Reviewing legal issues on behalf of Company with external advisors and counsel.

3. Independently handling high value and long term property projects including liaising with solicitors towards title due diligence of the property, drafting all property documents like, LOI, Lease Agreements, License Agreements, Bank Guarantees, etc. and conducting advanced level of negotiations with the developers, lessors, licensors, solicitors, etc.

4. Advising senior management on the various risks associated with property matters including developing a risk analysis and presentations to senior management.

5. Defining the strategy and legal stand of the company in so far as the cases under labelling laws are concerned, including streamlining the process of packaging & labelling laws at warehouses, ensure obtaining registrations under packaging & labelling laws for warehouses and Director nomination.

6. On case to case basis, advising brands on critical customer issues and vetting of communications including Non-Disclosure Agreement to/ with such customers

7. Independently handle documentation for lease premises including title verification, drafting, negotiating, finalising Letter of Intents, Agreements and also on termination / separation issues.

8. Giving advice to internal departments as may be required on a day to day basis for quick resolution of legal issues.

9. Discuss status of active litigations with Auditors.

C) Compliance:

1. In charge of monitoring the statutory Compliance Tool to ensure legal compliances for the spare parts business at all warehouses.

2. Part of the team that performs test checks for statutory compliances for various departments.
